1. Introduction

Welcome to EagleTunes, operated by Your Spark Music GmbH. These Terms and Conditions (the "Terms") govern your use of EagleTunes' website, services, and applications (collectively, the "Platform"). By using the Platform, you agree to these Terms in full.

2. Registration and Account

To use EagleTunes, you must register for an account. You are responsible for maintaining the confidentiality of your account information, and for all activity that occurs under your account. You must not allow others to use your account.

3. Content

You retain all ownership rights to the content you post on EagleTunes, including music, videos, and text content. By posting content, you grant us a non-exclusive, transferable, royalty-free, worldwide license to use, display, reproduce, distribute, and create derivative works of such content in connection with the Platform.

4. Prohibited Activities

You agree not to use the Platform for any unlawful purposes or in any way that could damage, disable, overburden, or impair it. You also agree not to use the Platform to harass or harm others, or to upload or share content that is hateful, threatening, pornographic, or that incites violence.

5. Artist Store and Transactions

Artists have the opportunity to sell a variety of products through the Artist Store on EagleTunes. Artists set their own prices and retain all rights to their music and products. A 15% transaction fee applies to every sale made through the Artist Store.

6. Services Platform

Our services platform allows artists to offer and book digital services. We do not guarantee the accuracy, completeness, or usefulness of any services offered and we do not endorse any services. We are not liable for any harm or damages related to the purchase or use of services.

7. Classified Listings and Auctions

EagleTunes allows users to post classified listings and participate in auctions. We do not oversee these transactions and are not involved in any transactions between buyers and sellers. We are not responsible for disputes, claims, loss, injury, or damage of any kind that might arise during or resulting from such transactions.

8. EagleTunes ArtistHub

Access to the Artist Store is granted through the EagleTunes ArtistHub, which provides various tools and resources to assist artists. These tools and resources are provided "as is" and we disclaim any warranties, express or implied, regarding their usefulness or effectiveness.

9. Changes to the Terms

We may revise these Terms at any time by updating this posting. You should visit this page from time to time to review the current Terms because they are binding on you.

10. Termination

We reserve the right to suspend or terminate your account at any time and for any reason, including if we determine that you have violated these Terms.

11. Governing Law

These Terms are governed by the laws of Germany without regard to its conflict of law provisions.

12. Disputes

Any disputes arising out of or relating to these Terms or the Platform will be resolved in the courts of Germany.

By using the Platform, you confirm that you understand and agree to these Terms and Conditions. If you do not agree to these Terms, you must not use the Platform.
